# Data Privacy

> Understand Hercules data ownership, AI training and Privacy Mode, GDPR compliance, data processing agreements, subprocessors, retention, and deletion rights.

We take your data privacy seriously. Enterprise customers can sign a Data Processing Agreement and enable Privacy Mode to exclude their content from future AI training and evaluation.

### Can I get a Data Processing Agreement?

Yes. Enterprise customers can receive a signed [Data Processing Agreement (DPA)](https://hercules.app/legal/data-processing-agreement) by emailing [sales@hercules.app](mailto:sales@hercules.app). It applies once signed or expressly incorporated into your signed agreement.

### Who owns my apps and data?

You retain your rights in your content and your users' content. Hercules assigns its rights in AI outputs generated for you to you, to the extent permitted by law.

Hercules retains ownership of its platform and usage data. Third-party materials retain their own terms. See [content ownership](https://hercules.app/legal/terms-of-service#9-your-content-and-our-rights).

### Is Hercules GDPR compliant?

Yes. An auditor's GDPR attestation is available through our [Trust Center](https://trust.hercules.app). Our DPA describes processing responsibilities and safeguards for international transfers.

### Does Hercules train AI on my data?

On self-serve plans, we reserve the right to use content to train, evaluate, and improve AI models and features, subject to applicable law and our terms.

On Enterprise, you can enable **Privacy Mode**. While enabled, your content and your users' content, including deidentified versions, are excluded from future training, evaluation, and improvement of AI models and features. We still process content to run, secure, and support the service.

### Who else processes my data?

We use providers for infrastructure, databases, AI, and other services. See the [subprocessor list](https://trust.hercules.app/subprocessors). Integrations you connect also process the data you authorize them to access.

### How long does Hercules retain data, and can I delete it?

Retention depends on the data, service needs, and legal obligations. Under our standard DPA, customer personal data is deleted within 90 days after the agreement ends, unless retention is legally required. ### Can I export my data?
