1. Prohibited Conduct#

You agree not to, and will not permit others to:

1. Reverse‑engineer, decompile, disassemble, or otherwise attempt to derive source code, underlying models, algorithms, or architecture of the Hercules Platform, except to the extent applicable law expressly prohibits this restriction.

2. Scrape, crawl, or harvest data from the Hercules Platform, including for machine‑learning training without our prior written consent. This does not restrict you from exporting your Customer Content and End User Content using the features we provide.

3. Circumvent, interfere with, bypass, or disable any security features, usage‑control features, or rate limits applied to any account, workspace, or API

4. Benchmark, train, or improve competing AI models using the Hercules Platform or its outputs.

5. Extract or reconstruct model weights, training data, or tunable parameters.

6. Generate or disseminate Prohibited Content as described in Section 2 below.

7. Upload or distribute malicious code, perform denial‑of‑service attacks, or overload the platform.

8. Send unsolicited, unauthorized, or intentionally deceptive communications such as abusive advertising, unsolicited bulk messages, or spam

9. Phish, spoof, or impersonate any person or entity.

10. Violate export-control or sanctions requirements. You must not use the Hercules Platform if you are located in, or are a resident of, a country subject to United States embargoes or sanctions. You must comply with applicable United States Export Administration Regulations and, where applicable, International Traffic in Arms Regulations.

11. Transmit sensitive regulated data including but not limited to protected health information, cardholder data subject to the Payment Card Industry Data Security Standard, or data classified under the International Traffic in Arms Regulations without our express written authorization and any legally required supplemental agreement (such as a business associate agreement under HIPAA).

12. Publish or disclose any performance or benchmark test results relating to the Hercules Platform or its underlying models without our prior written consent.

13. Interfere with or place an undue burden on the Hercules Platform for example, excessive automated requests or duplicating projects to evade limits

14. Create, register, or control accounts through automation or in bulk.

15. Conduct network attacks or port scans against the Hercules Platform or any third party.

16. Mine cryptocurrencies or run similarly resource‑intensive computations unrelated to your Customer Application.

17. Harvest personal data or otherwise infringe another user’s privacy.

18. Use multiple accounts or other means to evade a ban, suspension, or usage limit.

2. Prohibited Content#

You are solely responsible for the content you create, submit, and share on the Hercules Platform. The following content is prohibited and you agree not to post such content to the Hercules Platform. Where End Users can submit content to your Customer Application, you must take reasonable steps to prevent and remove the following content (“Prohibited Content”):

• Defamatory, harassing, abusive, threatening, bullying, or that incites violence against any person or group.

• Profanity, violent, or graphic content, including hate speech or symbols.

• Visual depictions or explicit descriptions of sex and nudity, including sexual advances and solicitation, and offers of sexual services, or any content that sexualizes minors, which we will report to the relevant authorities.

• Promoting illegal conduct.

• Malware, phishing, fraud, hoaxes, malware, and pyramid schemes.

• Infringing the intellectual property rights of others.

• Disrupting the experience of other users.

3. Responsible‑Use & Ethics#

You agree to use Hercules in a manner that is lawful, respectful, and consistent with the following principles:

1. Human oversight. Always review and test AI‑generated code and content before relying on it or deploying it to production.

2. No illegal or harmful activity. Do not use the Hercules Platform to break the law, violate third‑party rights, or create content that is fraudulent, defamatory, harassing, or hateful.

3. Respect privacy & confidentiality. Do not misuse personal data or disclose confidential information without authorization.

4. Intellectual‑property compliance. Ensure you have the right to use any data, prompts, or outputs and honor all relevant open‑source or proprietary licenses.

5. Safety & non‑discrimination. Avoid using AI outputs in ways that could cause physical harm or unlawful discrimination.

6. Transparency. Where required by law, or where End Users would otherwise reasonably believe they are interacting with a human, disclose that content or interactions are AI-generated.

4. High-risk activities#

Do not use the Hercules Platform or generated results for life-support systems, medical diagnosis or treatment, nuclear facilities, aviation, autonomous vehicles, or other activities where failure could cause death, personal injury, or severe property or environmental harm. The platform is not designed or certified for those purposes. Any such use is at your sole risk. To the extent permitted by law, Hercules disclaims any representation or warranty of fitness for those purposes and may immediately suspend or terminate access for attempted or actual prohibited use.

5. Enforcement#

This policy forms part of the Terms of Service. You are responsible for your Members, Customer Applications, Customer Agents, and their use. We may investigate prohibited use and immediately suspend or terminate access for a violation of this policy, subject to applicable law. Report abuse to abuse-reports@hercules.app.
