We respond expeditiously to copyright infringement notices under the Digital Millennium Copyright Act, 17 U.S.C. § 512. KNOWINGLY MAKING MATERIAL MISREPRESENTATIONS CAN EXPOSE YOU TO DAMAGES, COSTS, AND ATTORNEYS' FEES, AND A FALSE STATEMENT UNDER OATH MAY ALSO RESULT IN PERJURY PENALTIES. On receipt of a compliant notice, we will remove or disable access to the allegedly infringing material and notify the affected User, and we may forward a copy of the notice, including your contact information, to them.
Repeat infringers. We maintain and enforce a policy of terminating, in appropriate circumstances, the accounts of Users and the Organizations of Customers who are repeat infringers. We track infringement notices against the accounts and Organizations responsible for the material. Repeated notices concerning the same account or Organization, or a single instance of flagrant infringement, may result in suspension or termination without prior warning, and Customer Applications and Customer Agents associated with a terminated Organization may be unpublished. We may also, at our discretion, restrict the features available to an account that has been the subject of infringement notices.
This copyright procedure is for infringement notices and does not provide legal advice. You may wish to consult a lawyer about your rights and obligations.
2. Counter-notification#
If you believe removal resulted from mistake or misidentification, send a counter-notification to the email or mailing address above with your signature; identification and former location of the material; a statement under penalty of perjury of your good-faith belief in the mistake or misidentification; and your name, address, and telephone number.
Include consent to the jurisdiction of the federal district court for your address, or if outside the United States, a district where Hercules may be found, and agreement to accept service of process from the claimant or its agent. We forward compliant counter-notifications to the claimant. Where the statutory process applies, material may be restored between 10 and 14 business days after receipt unless we receive notice that the claimant filed an action seeking a court order restraining the allegedly infringing activity.
3. Trademark and Other Complaints#
Trademark Complaints. If you believe a Customer Application, Customer Agent, subdomain, or other material hosted through Hercules infringes your trademark or impersonates you, send a complaint to the email or mailing address above including: (a) your name, contact information, and, if you act for the trademark owner, evidence of your authority; (b) the trademark at issue, its registration number and jurisdiction or, for unregistered marks, evidence of your rights, and the goods or services it covers; (c) the location of the allegedly infringing material; (d) an explanation of why the material is likely to cause confusion or is not otherwise permitted, such as by nominative or descriptive fair use; and (e) a statement that the information is accurate and that you have a good-faith belief the use is unauthorized. Trademark complaints are not governed by the Digital Millennium Copyright Act. We review them in our discretion, may request additional evidence, and may decline to act on disputes between businesses that are more appropriately resolved between the parties or in court. Where we act, we will notify the affected User or Customer and may share the complaint with them.
Other complaints. For other intellectual property or unlawful-content complaints, identify the material, its location, the rights or laws involved, and the supporting facts, and send your complaint to the email or mailing address above. Separate legal processes may apply, and nothing in this policy limits our rights under the Terms of Service or Acceptable Use Policy.
